INFORMATION COLLECTION

Marley Spoon, and any third parties acting under Marley Spoon’s authorization, will not collect any personal information about you except when specifically and knowingly provided by you. Examples of such information are name, shipping and billing addresses, phone number, email address, credit card information and customer preferences data. Examples of ways in which we may collect such information from you include the following:

A. Personally Identifying Information

Registration and Ordering. Before using certain parts of this Site, registering to enter one of the Promotions and/or ordering products, you must complete a registration form. When registering, you will be prompted to provide certain personal information, depending on the applicable registration form, including, but not limited to, your name, shipping and billing addresses, phone number, email address and credit card number. In addition, you may also be asked to provide your country of residence and/or your organization’s country of operation, so we can comply with applicable laws and regulations, and for your gender. These kinds of personal information are used for billing purposes, to fulfill your orders, to verify entry into a Promotion, to ship any prizes won in connection with the applicable Promotion, to communicate with you about your order and this Site, to communicate with you about our products, and for internal data modeling and marketing purposes. If we encounter a problem when processing your order, we will use the personal information to contact you.

Email Addresses. Some areas of the Site allow you to enter your email address for purposes including, but not limited to: registering for a particular service or activity, registering to enter a Promotion or opening a Marley Spoon account. If you choose not to provide your email address when prompted, you may not be able to engage in some or all of those activities.

Information from Social Media. If you access or log-in to a Marley Spoon service through a social media website or other non-Marley Spoon service, or connect a Marley Spoon service to a social media website or other non-Marley Spoon service, the information we collect may also include your user ID and/or user name associated with that social media service, any information or content you have permitted the social media service to share with us, such as your profile picture, email address or friends lists, and any information you have made public in connection with that social media service. When you access the Marley Spoon services through social media services or when you connect a Marley Spoon service to social media services, you are authorizing Marley Spoon to collect, store, and use such information and content in accordance with this Privacy Policy.

Retargeting/Remarketing. We may from time to time contract with third party vendors to provide ads to our customers on our behalf via the Internet or to send direct mail to customers whom we think may be interested in our products or services. As part of this service, we may make available identifiers to these third parties including our visitors’ IP addresses, cookies, and hashed versions of email addresses captured from your visit. We, and third parties, use this data to obtain more information about our visitors and reach out to them through other channels, such as email and/or direct mail. You have the right to opt-out of this activity. To opt-out, please follow the instructions in the section ‘Do Not Sell My Personal Information’.

Data-Append Services. Marley Spoon may work with one or more data-modeling and/or data–append services which allow Marley Spoon to learn more about you from other websites, based on the information you have permitted Marley Spoon to gather directly (including your email address).

Chat function. Our website may include a “chat” function, which may be used to exchange information with you, to respond to any inquiries you may raise. We process the information addressed to us in this context to process the inquiry and to contact you. If you have chosen to or choose to register as a customer using the same data, the information exchanged via the chat function may be assigned to your customer profile.

B. Non-Personally Identifying Information

Log information. When you access the Marley Spoon Site our servers automatically record information that your browser sends whenever you visit a website. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Site, track users’ movement in the aggregate, and gather broad demographic information for aggregate use. This log information is not linked to personal information unless you are an active customer, or have otherwise provided such information to us. Third parties may also use tracking technologies such as web beacons, images, scripts and cookies to track information in the aggregate on our Site for analytics purposes. Marley Spoon does not control these third-party technologies and their use is governed by the privacy policies of third parties using such technologies. Cookies. Like most other websites, Marley Spoon uses cookie technology throughout this Site. A cookie is a small removable data file that is stored by your web browser on your computer which often includes an anonymous unique identifier. Cookies are used to provide customers with tighter security, customized content, tracking of orders and shopping cart items. Marley Spoon uses both session and persistent cookies on this Site; session cookies expire at the end of a particular visit to our Site, while persistent cookies (also called stored cookies) remain active until you disable them through your browser settings, or until a pre-set expiration date. Unfortunately, customers who turn off cookies in their browser settings will not be able to shop from this Site.

INFORMATION USE

We do not sell or rent information about our customers and all information provided to Marley Spoon remains absolutely confidential, except that:

We may share aggregate or summary information regarding our customers with partners, advertisers or other third parties. This data will never identify you personally.

We may share information with companies that provide support services to us (such as a printer, mailing house, fulfillment company, delivery company or web host) or that help us market our products and services across a variety of channels, including direct mail. This information may also be shared with marketers whose products or services we feel may be of interest to you. These companies may need information about you in order to perform their functions. These companies are not authorized to use any personal information we share with them about you for any other purpose.

C.

We will use your personal information to communicate with you about your orders and deliveries, and we may send you a confirmation email when you register/place an order with us. If you submit your email address to open a Marley Spoon account, we use it to deliver the information to you. In addition, if you submit your email address in connection with registering for a Promotion, we may use your email address to communicate with you regarding your participation in the applicable Promotion.

D.

In order to process inquiries made using the chat function, we work together with specialized service providers who process the contact requests and the associated data on our behalf. We and our service providers may record and store the communication for the duration of the contractual relationship with you or the existence of a customer account, but at the longest until we are requested to delete it.

E.

We may be required to disclose such information in response to subpoenas, court orders, requests from law-enforcement officials, or if we are otherwise required to disclose such information by law.

F.

We may publicly disclose the name, city, and state of the winner of any online sweepstakes.

G.

We may share your personal information with other members of an information co-op, whereby data from each member is shared with all other members of the co-op.

H.

We may share your email address, or other information you voluntarily provide to us, such as your hobbies, personal interests, household income range, number of children, gender, demographic information, and product and service preferences, with third-party partners (including Facebook®) for purposes of their provision to us of services, and/or our collection of information from such sources, based on such information solely for use in connection with our internal data-modeling and/or marketing or similar activities. Such third-party partners are not authorized to use your email address for any other purpose.

As we develop our business, we might sell or buy businesses or assets. In the event of a company sale, merger, reorganization, dissolution, or similar event, the personal information and other information you provide to us or that we have gathered about you may be part of the transferred assets.

PROTECTING YOUR INFORMATION

Shopping on the Site is easy, secure and worry-free. We have taken several measures to guarantee that your order and your credit card information are safe and secure. Our servers use Secure Sockets Layer (SSL), an advanced encryption technology that works with Microsoft Internet Explorer (version 3.0 and above), Netscape Navigator (versions 2.0 and above), AOL (AOL 3.0 and above), and many other browsers..

SSL is considered the industry standard and is among the leading software available to encrypt online transactions. Your personal information including your name, credit card number and address is encrypted so that it cannot be read as it is transmitted over the Internet. Regardless of these efforts, no data transmission over the Internet can be guaranteed to be 100% secure. Therefore, any information you transmit to us is sent at your own risk.

NON-US INFORMATION

You agree that your information will be held by Marley Spoon in the United States and may also be held and accessed by Marley Spoon staff and third parties working for Marley Spoon inside and outside the United States. If your information is gathered outside the United States, you agree that it may be transferred to Marley Spoon’s United States offices to be used for these purposes, and it may be transferred to and shared with any of Marley Spoon’s worldwide locations

CHILDREN’S PRIVACY

We do not intentionally collect personally identifiable information from children under the age of thirteen. If we become aware that we have collected personally identifiable information from a user of the Site who is under the age of thirteen, we will remove that child’s personal information from our files.

OPT OUT / CORRECTIONS

Upon your request, we will: (a) correct or update your personal information; (b) stop sending emails to your email address; and/or (c) disable your account to prevent any future purchases through that account. You can make these requests by emailing your request to Marley Spoon’s Customer Support department at contact@marleyspoon.com. Please clearly label the subject line “Opt Out / Corrections,” and do not email your credit-card number or other sensitive information.

Notwithstanding the foregoing, we may continue to contact you for the purpose of communicating information relating to your request for Marley Spoon Offerings, your participation in a Promotion and to respond to any inquiry or request made by you, as applicable. To opt-out of receiving Marley Spoon Offerings-related, Promotions-related and inquiry response-related messages from Marley Spoon, you must cease requesting and/or utilizing the Marley Spoon Offerings, cease participating in the Promotions and cease submitting inquiries to Marley Spoon, as applicable.

OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION

The majority of information that we collect is obtained through our Site, and this Privacy Policy applies only to that online collection of personal information, as well as the collection of personal information at one of our food trucks. We also collect information offline, where we also try to protect the privacy of your personal information. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the personal information we need in order to place the order or to answer the question. When we need to store information (such as order information), we will enter it into our database through SSL encryption. (See the Protecting Your Information section above for more information).

POLICY CHANGES

We may change our Privacy Policy from time-to-time without notice to you. We encourage you to refer to this Privacy Policy on an ongoing basis so that you understand our current Privacy Policy.
